Journalists have no statutory exemption from disclosing their sources to probe agencies: Delhi court

New Delhi:  A Delhi court has observed that there is no legal exception for journalists who need to reveal their sources to investigating agencies, particularly when doing so is vital to support and aid in the investigation of a criminal case.

The observation was made by Chief Metropolitan Magistrate of Rouse Avenue Courts, Anjani Mahajan.

The Central Bureau of Investigation (CBI) had issued a closing report in a case pertaining to a report published in newspapers and aired on TV channels regarding allegations of disproportionate assets against late Samajwadi Party supremo Mulayam Singh Yadav and his family members.

The CBI filed a complaint alleging that unidentified individuals had prepared fraudulent and falsified report to harm the reputation of CBI. It was stated that these people engaged in a criminal conspiracy with the intention of forging documents and using them as real documents in order to spread misleading information.

However, the court observed that a bare perusal of the closure report showed that the CBI had declined to carry the investigation to its logical conclusion.

“Merely because the concerned journalists denied to reveal their respective sources, as stated in the final report, the investigating agency should not have put a halt to the entire investigation. There is no statutory exemption in India to journalists from disclosing their sources to investigating agencies, more so where such disclosure is necessary for the purpose of aiding and assisting in investigation of a criminal case, ” the court said.

“The CBI is well within its power to direct the concerned journalists/news agencies by way of notices u/s 91 Cr.P.C. etc. to provide the required information and bring to their notice the requisite facts of the case warranting disclosure of the information as per law, ” it further noted.

The court noted that only Chaubey was mentioned as a witness in the list of witnesses filed by CBI along with closure report and there was no mention of journalists Deepak Chaurasia, Bhupinder Chaubey and Manoj Mitta as they were also examined.

“There are no statements u/s 161 Cr.P.C. of Deepak Chaurasia and Manoj Mitta on the record nor are they cited as witnesses in either of the lists of the witnesses filed by the CBI.”

The court made the observation that more inquiry from the journalists regarding their sources from whom the allegedly fabricated papers were obtained and used as the basis for their news items must be carried out.

“Further, based on such information, additional clues regarding the identities of the culprits who entered into the alleged criminal conspiracy, prepared and fraudulently and knowingly used as genuine the forged document by providing it to the media/ getting it published/aired, could be found and probed. Further investigation on this aspect is thus required to be conducted, ” it added.

J&K polls decision after considering security, weather: ECI

Chief Election Commissioner (CEC) Rajiv Kumar said on Wednesday that the assembly elections in Jammu and Kashmir will be held with various factors in mind, including weather and security concerns.

“We are conscious that in any place which is due for elections, it is our duty that we get the government in place as mandated,” Kumar told the reporters in New Delhi.

The CEC said that the delimitation process and the revision of electoral rolls in the union territory has been completed. Similarly, returning officers and additional electoral registration officers have also been appointed.

“We are aware that once the process is complete, they (polls) must be held. And taking the weather, taking the security concerns and all other factors…other elections at that time…. (into consideration, we will take a decision),” the CEC said.

J&K has not had an elected government since June 2018, when Governor’s rule was imposed after the PDP-led coalition government lost its majority following the withdrawal of support by the BJP. The last four years have witnessed a drastic political makeover of the state-turned-union territory, so much so that in many aspects, the current J&K bears little resemblance to what it was pre-August 2019.

Gadkari calls for efforts by all to reduce road accidents by 50%

New Delhi : Union Road Transport and Highways Minister Nitin Gadkari on Wednesday said efforts by all are necessary to reduce road accidents by 50 per cent before the end of 2025.

Participating in a 4-hour telethon and outreach campaign “Sadak Suraksha Abhiyan” during the Road Safety week, he said a law will soon be brought in the country to determine the working hours of truck drivers.

During the event, megastar Amitabh Bachchan, Isha Foundation founder Sadhguru and many other stakeholders discussed the key issues related to road safety.

Officials said that the Road Transport & Highways Ministry has undertaken multiple initiatives across all 4Es of Road Safety including Engineering, Enforcement, Education and Emergency Care for reduction in road fatalities and injuries. This year, it observed the Road Safety Week (RSW) from January 11 to 17, under “Swachhata Pakhwada”, to propagate the cause of ‘Safer Roads for All’.

During the Week, the Ministry conducted multiple activities at various locations in Delhi including ‘nukkad nataks’ (street shows), sensitisation campaigns, competitions for school & college students, road safety exhibitions in collaboration with corporates, walkathons, talk shows, and panel discussions with senior government officers and industry leaders.

In addition, road owning agencies such as NHAI, NHIDCL etc. conducted special drives related to compliance of traffic rules and regulation, pedestrian safety, eye check-up camps for drivers at Toll Plazas and other road engineering related initiatives. Transport and police departments of states and UTs, NGOs, private companies and general public across the country also actively participated in the event by conducting awareness campaigns, first responder training, ensuring strict enforcement of rules & regulations up to grass root levels and conducting other activities, workshops & advocacy programmes related to road safety.

Shivani was a part of “Operation Ganga”,that evacuated students from Ukraine last year. With her motto “duty – first” she proudly partook the activity and flew to war zone area evacuating the stranded students in Ukraine.  Undoubtedly, she has broken all barriers and have made her mark in a men’s field. Operation Ganga was aimed to bring back thousands of students from Ukraine trapped in war zone.

Addressing the Students of Delhi University in a Youth Conclave, at PGDAV College Delhi, Shivani said women are multi-tasker. They can do several things at a same time. Recollecting her experience she shared few things with the students, she is happy that she was a part of “Operation Ganga” that evacuated 249 Indian students from Budapest, Romania. Students at Ukraine were eagerly waiting for us and their scared faces tuned into smile when they saw us. Initially my family was worried for me , but they did not stop me. When I came back from Ukraine, my parents said they are proud of me, added Kalra.

A women with wings and courage, also asked the students to raise their hands if they have decided a  carrier option for them, to which many students replied by lifting their hands, the undecided students failed to raise the hands, to them  Shivani said ,” I was one among you”.  It is okay if you have not decided yet, you still have time, Even I had no plans to join the Aviation Industry earlier, she added.

One of the student during the event, raised a question “You have faced a lot of criticism mam were you ever been demotivated?” And how did you deal with it, To this she replied “ Demotivated word does not exist in my dictionary” I have faced a lot of criticism in my life, I was rejected many times but I never lose faith in myself. Even after facing lot of criticism, I stood focused and continued working hard and I had faith in the Almighty.  If you are determined no body can stop you, added Kalra.

Coming up from an orthodox family of Haryana where society is inclined towards marriage of girls at a early age, it was very difficult for  to convince her friends and family. On being asked about her decision to chose Aviation Industry as her career, Shivani replied her parents have always supported her, especially her father who not only  encouraged her but also stood by her throughout the journey. She guided the young girls at the college to never lose hope and stay focused on whatever they choose for them. It is the determination and dedication that will cater us success, she added.

Shivani Kalra is an Airline Captain at Air India limited. She began flying for Air India since 2018 and had never stopped yet.

K. Chandrasekhar Rao had breakfast meeting with chief ministers of three states

New Delhi : Telangana Chief Minister K. Chandrasekhar Rao on Wednesday had breakfast meeting with chief ministers of three states and leaders of various political parties who will be attending Bharat Rashtra Samithi’s inaugural meeting at Khammam later in the day.
Delhi Chief Minister Arvind Kejriwal, Punjab Chief Minister Bhagwant Mann, Kerala Chief Minister Pinarayi Vijayan, Uttar Pradesh’s former chief minister Akhilesh Yadav, CPI national general secretary D.A Raja and other leaders attended the breakfast meeting at the chief minister’s official residence Pragati Bhavan.
The leaders had reached Hyderabad on Tuesday night to attend the BRS public meeting.
Chief Minister KCR welcomed the guests when they reached his official residence and presented them bouquets and shawls.
The BRS chief is understood to have discussed national politics with his counterparts from three states and other leaders.
Chief Minister KCR, along with other leaders, later left for Yadgirigutta to offer special puja at Yadagiri Lakshmi Narasimha Swamy temple.
Telangana ministers Vemula Prashanth Reddy, Talasani Srinivas Yadav, MP Joginapally Santosh Kumar and MLC Kavitha also accompanied them.
After landing at Yadagirigutta, all the leaders drove to the Presidential Suite at the renovated temple. They later visited the temple where priests accorded them traditional welcome.

Avoid ‘unnecessary remarks’ on films says PM Modi

New Delhi: Prime Minister Narendra Modi has asked BJP workers to refrain from making “unnecessary” comments about films.
He made the observation while addressing the last day of the two-day National Executive meet here on Tuesday.
During his address, Modi also asked BJP members to reach out to every section of society, including minorities such as Bohras, Pasmandas and Sikhs, and work for them without electoral considerations.
The Prime Minister’s statement comes amid the recent protests against Shah Rukh Khan’s film ‘Pathaan’, with several BJP leaders like Ram Kadam and Narottam Mishra criticising the makers over Deepika Padukone’s saffron costume in the song ‘Besharam Rang’.
The song has been in news for a saffron coloured bikini worn by Deepika along with a few shots that several politicians and trolls found ‘vulgar’.
As per reports, Hindu sentiments have been hurt and people have also criticised the makers as they find an “overdose” of the sexually appealing look of the actress.
Protests are on with the social media campaign seeking boycott of the movie.

Chilly morning greets Delhiites, air quality falls to ‘very poor’ category

Amid the ongoing cold wave, the minimum temperature in the national capital plunged to 2.6 degrees Celsius on Wednesday, according to India Meteorological Department (IMD).

While the Safdarjung Observatory recorded 2.6 degrees Celsius, the Palam area registered a low of 6 degrees and Lodhi road was at 2.2 degrees.

According to the weather man, rainfall or thunderstorm is likely between January 22 and 25 with peak activity on January 23 and 24 over the plains of northwest India, including Punjab, Haryana, Uttar Pradesh, and north Rajasthan.

“However, light to moderate hailstorm is likely at isolated places over Jammu, Himachal Pradesh, Uttarakhand, Punjab, Haryana, Chandigarh, Delhi, west Uttar Pradesh and north Rajasthan on January 23 and 24, ” it said.

The IMD has also predicted strong surface winds (speeds reaching 30-40 Kmph) with gusty winds (speeds reaching 50 Kmph) as very likely to prevail over Punjab, Haryana, Delhi and west Uttar Pradesh occasionally on January 23 and 24.

In the national capital, the air quality has entered into a “very poor” category with overall AQI at 316.

Notably, an AQI between zero and 50 is considered “good”, 51 and 100 “satisfactory”, 101 and 200 “moderate”, 201 and 300 “poor”, 301 and 400 “very poor”, and 401 and 500 “severe”.

At Pusa, the AQI was recorded at 318 falling under “very poor” category.

The Air Quality Index reached 245 at Lodhi Road, while in Ayanagar, it was at 273.

According to the forecast from the System of Air Quality and Weather Forecasting And Research (SAFAR), the air quality of the city will deteriorate further on Thursday.

Punjab CM Mann’s big decision, Scraps Liquor factory operation at Zira with immediate effect

Chandigarh: Punjab Chief Minister Bhagwant Mann today announced to scarp up the Marlboro liquor manufacturing project with immediate effect for preserving the environment of the state.

Announcing the scrapping of this project, the Chief Minister categorically said that no one, however affluent he may be, will not be allowed to take the environmental norms for granted. He said that whoever will flout the stipulated norms framed by the state government will be dealt with sternly. Bhagwant Mann said that the decision has been taken after due deliberations with environmental experts and legal luminaries.

The Chief Minister said that keeping in view the castigating effects of this project on the environment and ecology of the state this project has been shelved. Bhagwant Mann said that the project could have disturb the ecological balance of the area. He said that keeping in view the repercussions of this project on the environment and human life, the state government has decided to wind up with immediate effect

Punjab  Chief Minister reiterated the firm commitment of the state government to check the environmental pollution for making Punjab clean, green and pollution free. He unequivocally said that no one will be allowed to play havoc with the environmental conditions of the state. Bhagwant Mann said that he will take every step to ensure the well being of the state and its people.

BJP all set to launch Rath Yatra in Karnataka

Bengaluru: Ruling BJP in Karnataka is all set to take out a ‘Rath Yatra’ in the state after the budget session ahead of Assembly elections.
The Rath Yatra would be taken out from four directions in the state to reach out to the people.
Chief Minister Basavaraj Bommai has stated on Monday late night that the details regarding the same are yet to be finalised. CM Bommai is taking part in the two-day National Executive Committee meeting.
He also stated that many political decisions were being taken in the meeting. The information right from the booth level to the party organisation had been given.
The high command is likely to take a call regarding B.Y. Vijayendra, son of party veteran B.S. Yediyurappa. The party had snubbed him during the recent visit of Prime Minister Narendra Modi to Hubballi to inaugurate the National Youth Festival.
BJP MLA Basanagouda Patil Yatnal from Vijayapura has attacked the ruling BJP government in Karnataka over providing reservation to Panchamasali sub sect under OBC quota. He had attacked CM Bommai and cabinet ministers also. The religious seer had warned that if BJP expels MLA Yatnal, the Panchamasali community will stand with him.
Chief Minister Bommai is in a fix over the matter. He maintained that the matter had been brought to the notice of the high command and a decision would be taken in this regard after the national executive.
The saffron party is seriously putting all efforts to come back to power in the state on Hindutva agenda and in the name of PM Modi.

‘Who is LG to stop’, Kejriwal on tussle over teachers’ training in Finland

New Delhi: During winter session of Delhi Assembly on Tuesday, Chief Minister Arvind Kejriwal lashed out at Lieutenant Governor V.K. Saxena over the ongoing tussle between the AAP government and the L-G office over sending government school teachers to Finland for training purposes.
“We have the money of the people of Delhi who pay taxes. It is on taxpayers’ money that the elected government of Delhi is sending teachers for training to Finland. Who is L-G to stop them, ” Kejriwal asked.
“It seems like ‘Begani Shaadi Mein Abdullah Deewana’ (a person who takes too much interest in the affairs of others). Why is the L-G sitting on our head? The L-G is saying get the training done in the country itself… Why get it done here, ” the Chief Minister questioned.
Kejriwal added that in a bid to motivate them and increase their efficiency, 30 teachers need to go to Finland for training.
“This has been decided by the elected Chief Minister and the Education Minister. But strangely, all the files have go to the L-G for approval. The L-G has objected twice which reflects his bad intentions.
“Repeated objections mean that the intention is bad and the teachers should not be allowed to go. Many MPs have studied abroad, their children have gone abroad to study. Was any cost-benefit analysis done then, ” Kejriwal asked, adding that it is a feudalistic mentality that the poor are not allowed to move ahead.
“The L-G does not have the power to do this. The Supreme Court had clearly said in 2018 that the L-G does not have the right to take a decision in any matter other than the police, law and order, and services. I went to meet the L-G two-three days ago and told him the same, to which he said yes, this may be the opinion of the Supreme Court, ” Kejriwal said.
“After this, I had nothing to say because a person sitting on such a big constitutional post is saying that this is the opinion of the Supreme Court. Every citizen of this country is bound to obey the orders of the Supreme Court, ” the Chief Minister told the House.
