Consumers be given the right to choice, consent over their data: TRAI

In a significant recommendations concerning privacy, security and ownership of data in telecom sector the Telecom Regulatory Authority of India (TRAI) said on July 16 that rules for protection of personal data in the telecom space are not sufficient and suggests that consumers be given the right to choice, consent and to be forgotten to safeguard their privacy.

The recommendations from TRAI came in the backdrop of rising concerns around privacy and safety of user data, especially through mobile apps and social media platforms.

“The Right to Choice, Notice, Consent, Data Portability, and Right to be Forgotten should be conferred upon the telecommunication consumers,” TRAI recommended to the Department of Telecom.

TRAI also recommends that all entities in the digital ecosystem, which control or process the data, should be restrained from using meta-data to identify the individual users.

“This is the first time I’ve seen TRAI being bold enough to venture into this area. There are many positives here in terms of the data protection regime that they want to set up,” Pranesh Prakash, a policy director at the Centre for Internet Society reportedly said during an interview.

TRAI also recommends that a study should be undertaken to formulate the standards for annonymisation/de-identification of personal data generated and collected in the digital eco-system.

Telecom industry body COAI Director General Rajan S Mathews said, “One of the positive takeaways from the recommendations is that TRAI has talked about data privacy in the context of devices, operating systems, browsers and applications.”

“Till such time a general data protection law is notified by the government, the existing rules/licence conditions applicable to TSPs for protection of users’ privacy be made applicable to all the entities in the digital ecosystem,” TRAI recommendation reads.

Obligation to run judicial system ‘must’ rest only with judiciary: RS Prasad

Union Minister Ravi Shankar Prasad asserted that a free judicial system is essential for democracy while delivering a lecture on July 16 at an event at Indian Society of International Law.

“A free judicial system is essential for democracy. It is the duty of the government to give assistance and infrastructure but the obligation to run the judicial system must rest only and only with the judiciary,” minister added.

Minister also said that there should be accountability in the judiciary, something which would help judges find out whether the system is in order.

He said, “If there is a need for accountability in all forms of government, then, there is also a need for considering the possibility of accountability among the judiciary as to how the system is working, do we need to expedite it, do we need to explore extra avenues”.

CBI files charge sheet against Farooq Abdullah in JKCA multi-crore scam

The CBI on July 16 has filed a charge sheet against Farooq Abdullah, former Jammu and Kashmir chief minister and Mohammed Salim Khan, association general secretary, treasurer Ahsan Ahmed Mirza and Basheer Ahmad Misgar, Jammu and Kashmir Bank executive, in the Jammu and Kashmir Cricket Association (JKCA) multi-crore scam.

According to reports, Farooq Abdullah and three others have been charged under IPC sections related to criminal conspiracy and criminal breach of trust.

CBI has alleged that in the year between 2002 and 2011, the BCCI (Board of Control for Cricket in India) gave the JKCA 112 crore as grant for promotion of cricket in the state. Of the total amount, there was a misappropriation of 43.69 crore fund by the accused.

The JKCA scam came into light in the year 2012 when the then association chairman Muhammad Aslam Goni accused Khan and Mirza of drawing off the money by transferring into an account that is not related to the association. Farooq Abdullah was the association president at the time of scam.

JKCA accounts were frozen following a Public Interest Litigation filed by two cricketers- Majid Yaqoob Dar and Nissar Ahmad Khan into the alleged scam.

The High Court had asked the CBI to take over the case after the failure of state police to conclude its probe even after three years.

Congress President offers ‘unconditional support’ on women’s bill in a letter to PM Modi

The Congress will offer “unconditional support” to the women’s reservation bill in the upcoming Monsoon session of Parliament, Congress Party President Rahul Gandhi said on July 16. The bill aims to reserve a third of seats in parliament and legislatures for women.

Rahul Gandhi’s statement came in the backdrop of Prime Minister Narendra Modi’s remarks on the party, “If Congress is a party meant for Muslims, it’s up to them. But is it a party meant only for Muslim men? Because you don’t stand with the Muslim women on issues such as triple talaq and nikah halala.”

“Our PM says he’s a crusader for women’s empowerment? Time for him to rise above party politics, walk-his-talk & have the Women’s Reservation Bill passed by Parliament. The Congress offers him its unconditional support,” tweeted Rahul.

“Mr Prime Minister, in many of your public rallies you have spoken about your passion for empowering women and involving them more meaningfully in public life. What better way to demonstrate your commitment to the cause of women than by offering your unconditional support to the passage of the Women’s Reservation Bill? And what better time, than the upcoming session of parliament?” Rahul tweeted to Prime Minister Narendra Modi. .

“I write to you to request your support to ensure the passage of the women’s reservation bill in the upcoming Monsoon session of Parliament,” Gandhi wrote in his letter to the prime minister.

He also added that his party has already collected over 3.2 million signatures in support of the bill.

Congress leader Tharoor accuses BJP of vandalizing his office in Thiruvananthapuram

Shashi Tharoor, Congress leader and Thiruvananthapuram MP, has accused Bhartiya Janata Party (BJP) Yuva Morcha activists of vandalising his constituency office on July 16 in Thiruvananthapuram, Kerala.

“Today @YUVAMORCHABJP vandals attacked my constituency office in Thiruvananthapuram. They poured black engine oil on signs, doors, walls & gate, drove away innocent citizens waiting with their petitions, put up offensive banners & shouted slogans asking me to go to Pakistan,” Tharoor’s tweet reads.

The incident took place in wake of Tharoor’s latest statement alleging that if the BJP comes to power again after the 2019 Lok Sabha election, then the country will become a ‘Hindu Pakistan’. Victory in 2019, he said, would give Prime Minister Narendra Modi’s party “all the elements they need to tear apart the Constitution of India and write a new one”.

Activists demanded an apology from Tharoor over his comments on BJP that has sparked a big political controversy. The attackers also demanded Tharoor to leave the country.

Following the attack, Tharoor said, “People had come with their concerns but you scared them away from here. Is this what we want in our country? I am asking as a citizen, not as an MP. This is not the Hinduism that I know of.”

“After today’s alleged act of violence by the BJP, even Hindus will distance themselves from the ‘Sanghi goondas'”, added Tharoor.

S. Suresh Thiruvananthapuram district BJP President has said that the incident was a protest against a wrong statement. “This protest took place as Tharoor is the Lok Sabha member from here and hence this is nothing but a natural protest because of his erroneous statement,” he added.

State Congress President M.M. Hassan and Leader of opposition Ramesh Chennithala have strongly condemned the attack on Tharoor’s office.

NIA court sends Dukhtaran-e-Milat chief Asiya Andrabi, 2 others to 30 days judicial custody

The National Investigation Agency (NIA) court on July 16 sent separatist Asiya Andrabi (chief of Kashmiri women group Dukhtaran-e-Milat) and two other women associates (Sofi Fehmeeda and Nahida Nasreen) for 30 days judicial custody in connection with alleged involvement in conspiracy and acts to severely destabilise the sovereignty and integrity of India with support from Pakistan.

Dukhtaran-e-Milat chief and two other associates were produced before the court amidst tight security.

The NIA added that the trio had been using various media platforms to spread insurrectionary imputations and hateful speeches advocating the use of violence against India and the secession of Jammu and Kashmir.

During the probe, several mobile numbers used by members of Dukhtaran-e-Millat were also collected and analysed. NIA probe revealed that the mobile details exposed that they are in regular contact with their associates in Pakistan and involved in anti-India activities.

The NIA further informed the court that the arrested members were allegedly running a concerted campaign on social media to solicit the support of Pakistani establishment which inter-alia includes arranging support from banned terrorist groups from Pakistan.

The arrest was reportedly made on the recommendations given at a security meeting chaired by National Security Advisor Ajit Doval in New Delhi on March 3.

Sacred Games: Delhi HC says actors cannot be held liable for the dialogues

The Delhi High Court (HC) on July 16 while hearing the petition demanding deletion of certain scenes from Netflix web series ‘Sacred Games’ as they allegedly defamed former Prime Minister Rajiv Gandhi said that the actors cannot be held liable for the dialogues in the series.

The plea also alleged that the web series incorrectly depicted historical events of the country.

The Bench of Justices Sanjiv Khanna and Chander Shekhar has said that it has gone through the CD of the series, placed on record by the petitioner, and there was nothing urgent in it as all the episodes have been aired.

The court added that since all the episodes have already been aired, nothing new episode will come up, and has adjourned the matter to July 19.

Senior advocate Chander Lal, appearing for Netflix, and senior advocate Rajiv Nayar, representing production house Phantom, have said that the series has in total eight episodes that have already been aired and does not require a CBFC (Central Board of Film certificate).

The controversy sparked over the ‘sacred games’ when a complaint was filed by Rajiv Sinha, a Congress member from West Bengal, alleging that the series was “misrepresenting facts during his (Rajiv Gandhi) regime”.

Nikhil Bhalla (associated with Congress) has also filed the public interest litigation. He alleged that the show has some scenes where derogatory language has been used against Rajiv Gandhi. The petition also alleges that the show “incorrectly depicts historical events of the country like Bofors case, Shah Bano case, Babri Masjid case and communal riots”.

The Congress president Rahul Gandhi said that his father lived and died in the service of India and “the views of a character on a fictional web series can never change that”.
