Odisha Govt adopts ‘No Work No Pay’ policy for agitating employees in SME department

The Odisha government has adopted ‘No Work No Pay’ policy in the School and Mass Education (SME) department in respect of officers/officials who had gone on a 40-day strike.

Prabhat Kumar Bhoi, Additional Secretary to the state department, has written to all Directors under SME Department informing about the decision.

The additional secretary’s letter reads, “I am directed to intimate you that it has been decided to adopt the principle of “No Work No Pay” in respect of the Officers/Officials those who have been participated in the strike neglecting their official assignments since long (sic).”

“You are, therefore, requested to report compliance of the same to this Department for kind appraisal of the Principal Secretary,” the letter instructed.

On September 24, teachers, lecturers and employees of block grant schools and colleges resumed duty after their 40-day long resumed work but they are continuing with their symbolic protest to press for their demands by wearing black badges.

Supreme Court decriminalizes adultery, says it can be result of an unhappy marriage

While scrapping a 158-year law that punished a man for adultery but not the woman, treating her as her husband’s property, the Supreme Court says Adultery is no longer a crime in India but could be a ground for divorce.

A SC five-judge bench headed by Chief Justice of India Dipak Misra while stating that the law offends the dignity of women, said “Husband is not the master of the wife. Any provision treating a woman with inequality is not constitutional.”

The SC added that “without a shadow of doubt”, it can still be grounds for divorce.

The apex court bench added, “Adultery might not be the cause of an unhappy marriage, it could be the result of an unhappy marriage. Mere adultery can’t be a crime unless it attracts the scope of Section 306 (abetment to suicide) of the IPC. Thinking of adultery as a criminal offence is a retrograde step.”

CJI Misra added, “there can’t be any social licence which destroys a home.”

SC judges felt, “In case of adultery, criminal law expects people to be loyal which is a command which gets into the realm of privacy.” 

Is Haryana Urban Local Bodies favouring big contractors under Amrut?

Allotment of works under the much-touted Atal Mission for Rejuvenation and Urban Transformation (Amrut) has come under criticism for award of works to handful of contractors on hefty rates.  The Haryana Urban Local Bodies Department has been entrusted to execute the prestigious AMRUT project, under the Union Ministry of Housing and Urban Affairs in Haryana worth Rs.2800 crores.

In a memorandum to Haryana chief minister, Manohar Lal Khattar, Anti Corruption Forum of Haryana, a Karnal based NGO has alleged that the Urban Local Bodies has been allotting the works to a select few contractors at highly inflated rates which are around 25 percent higher than the rates being sanctioned by Haryana Public Health Engineering Department for equivalent projects executed by them. The memorandum says that this matter can be easily verified from the departmental records. It alleges that the issue of abnormally high rates has many a times been objected to by the officials of Public Health Engineering Department (PHED) during State Level Technical Committee meetings as recorded in minutes which are verifiable. Naturally the question arises as to when there already exists Haryana Directorate of Supplies and Disposals, which procures material at best rates through the High Powered Purchase Committee and is working efficiently, where was the need for allotting the works to select big contractors on a turn key basis?.

Ultimately because of these wrongs Public Health has disassociated itself from the meetings associated with allocation of works to contractors under AMRUT.

In fact Rajiv Arora, Additional Chief Secretary, Public Health, Haryana told Tehelka that “PHED will continue following the old procedures that we had been following in the past”. That makes it clear that Public Health Engineering Department, Haryana has shown wisdom to not to follow the ULBs. As such PHED would not squander public money by allotting works to a handful of contractors. A top engineer from the PHED Haryana too agreed to what Rajiv Arora opined and said that the department shall continue with the time tested policy of awarding works to direct suppliers than to handful of contractors on turn key basis.

The memorandum to the chief minister alleged that the ULB is being guided by a lobby of big contractors and smaller Detailed Notice Inviting Tender (DNIT) are being consolidated into 1-2 DNIT’s with financial prequalification’s which eliminate all local and small contractors thus leaving the field open only for big contractors who then quote inflated rates to bag contracts resulting in huge losses to the state exchequer running into hundreds of crores.

The memorandum mentions that the ULB department has deviated from the very effective and successful process of works execution carried out till today by the nodal department PHED.   The PHED in order to achieve faster and economical execution of water supply and sewerage projects has adopted a small package approach where in DNIT’s of smaller value are floated which qualifies local, small and medium scale contractors favoring the mission of “Swa-rozgar” promoted by Prime Minister Narendra Modi.

The capital-intensive components of the projects consisting of pipes,  LG screens and cement are procured at competitive rates by state government through annual rates contract negotiated by High Powered  Purchase Committee headed by the State Finance Minister. Again the question arises as to when there already exists Haryana Directorate of Supplies and Disposals, which procures material at best rates through the High Powered Purchase Committee and is working efficiently, where was the need for allotting the works to select big contractors on a turn key basis?.

However, the ULB has adopted a reverse approach where in only large DNIT’s are being formulated to qualify only few large contractors. Even CVC guidelines have been flouted wherein works of Ambala and Sonipat were awarded against single bids to one large contractor. The memorandum alleges that the work was awarded at more than 25 per cent of the estimated rates in DNIT.

By deviating from the time-tested practice, the ULB is thus ensuring that pooled bids of only few favored contractors are received. It can be observed that not more than two bids have been received against DNIT’s floated since April 1, 2018 for approximately 8-10 tenders for AMRUT projects. The Anti Corruption Forum questioned as to what was preventing the ULB department to follow the tried, tested, economical and successful model of PHED.  The memorandum sent to the chief minister demands that the Urban Local Bodies department should be asked to explain about the elements responsible for this huge loss to the state and public money.

Copies of the memorandum have been sent to State Finance Minister, Urban Local Bodies Minister, Public Health Minister, Principal Secretary to the chief minister, Additional Chief Secretary for ULB, PHED, PWDB&R, CA, HSAMB and CA, Haryana Shehri Vikas Pradhikara, CA, HSAMB, MD, HSIIDC, Director, Supplies and Disposals, Engineer -in- Chief PHED, Engineer -in- Chief PWD B&R, Engineer -in- Chief HSAMB, CE, ULB, CE, HSVP, Kiran Chaudhary, Leader of CLP and others.

Antigua assures India of cooperation on Mehul Choksi’s extradition

Foreign Minister Sushma Swaraj, who is in New York for the 73rd session of the United Nations General Assembly (UNGA), had spoken with her Antiguan counterpart on the extradition of Mehul Choksi, prime accused in the Punjab National Bank scam.

According to the External Affairs Ministry Spokesperson Raveesh Kumar, Antigua and Barbuda have assured India for all the cooperation in extraditing fugitive jewellery Mehul Choksi as soon as the legal formalities and court procedures are over.

Foreign Minister Chet Greene, assured Swaraj of all cooperation but Antigua would first examine legal procedures.

“EAM @SushmaSwaraj met the Foreign Minister of Antigua & Barbuda Chet Greene on the sidelines of #UNGA. Mr. Greene conveyed to EAM the assurances of his Prime Minister for the fullest cooperation of their Government in the matter of extradition of Mehul Choksi to India,” Kumar tweeted.

According to the Ministry of External Affairs, Swaraj, during the bilateral meeting, conveyed to Chet Green that there was immense expectation in India regarding Choksi’s extradition, since he fled the country after committing a massive fraud.

Mehul Choksi, who is wanted in India over his alleged involvement in a scheme that defrauded Punjab National Bank worth Rs 13400 crore, has reportedly taken the citizenship of the Caribbean island nation.

DMK President MK Stalin hospitalised with Kidney infection

MK Stalin, president of Dravida Munnetra Kazhagam (DMK), was admitted to the Apollo hospital in Chennai late Wednesday night.

According to the reports, DMK chief was admitted for the treatment of kidney infection.

Sources says, Stalin. 65 felt discomfort in his Alwarpet house around midnight and was suddenly taken to Apollo hospital.

However, Doctors examining Stalin advised him to take rest for two or three days

MK Stalin took the charge of DMK as President on August 28 after the death of his father and DMK supremo Karunanidhi on August 7.

MK Stalin’s journey in politics started with campaigning along with his father at the early age of 14. He became the party’s youth – wing secretary in 1984 and party deputy general secretary in 2003.

Indian Govt hikes custom duty on 19 items to curb current account deficit

Indian Government announced a hike in customs duty on 19 items to curb “non-essential imports” and narrow the current account deficit.

The Finance Ministry said, “The central government has taken tariff measures, by way of increase in the basic customs duty, to curb import of certain imported items. These changes aim at narrowing the current account deficit (CAD) … In all the customs duty has been increased on 19 items.”

The move follows an announcement to this effect by Finance Minister Arun Jaitley earlier this month after a meeting with Prime Minister Narendra Modi in the wake of fall of Indian rupee against dollar.

The import duty is raised on 19 items, such as aviation turbine fuel (ATF), consumer appliances such as television, refrigerator, air conditioner and speakers, washing machines, footwear, jewellery, furniture fittings, radial car tyres etc.

The total value of imports of these items stood at Rs. 86,000 crore in last fiscal, the Ministry of Finance noted.

Official statement reveals that the import duty was doubled to 20 per cent on ACs, refrigerators, and washing machines of less than 10 kilograms.

This revision in the rates of basic customs duty will be effective from midnight of September 26-27.

UN selects PM Modi for highest environmental honour ‘Champions of the Earth Awards’

Prime Minister Narendra Modi has been awarded with the United Nation’s (UN) highest environmental honour, ‘Champions of the Earth Awards’ announced on September 26, bestowed upon five other individuals and organisations, for his leadership of the International Solar Alliance and unprecedented pledge to eliminate single use plastic in India by 2022.

PM Modi is among the six of the world’s most outstanding environmental change makers.

UN Environment Programme (UNEP) said, “This years’ laureates are recognised for a combination of bold, innovative and tireless efforts to tackle some of the most urgent environmental issues of our time.”

BJP president Amit Shah tweeted “It is a matter of great pride for every Indian” that PM has been awarded the UN’s highest recognition for people whose actions have had a transformative impact on the environment.

Cochin International Airport has also been honoured with the award for Entrepreneurial Vision, for its leadership in the use of sustainable energy.

“Cochin is showing the world that our ever-expanding network of global movement doesn’t have to harm the environment. As the pace of society continues to increase, the world’s first fully solar-powered airport is proof positive that green business is good business,” UNEP said.

The UNEP said that the awards will be presented during the Champions of the Earth Gala in New York City, on the sidelines of the 73rd UN General Assembly. 

Jammu and Kashmir: Separate encounters launch by Security forces

The security forces on Thursday launched multiple counter-terrorist operations in several areas of Jammu and Kashmir (J&K).

A civilian was killed in a crossfire in Srinagar, while an Army man and a militant were killed in a gunbattle at Dooru in Anantnag district.

In a separate incident, there is an ongoing encounter in Budgam district.

In another encounter, gunfight began in Noorbagh area after the security forces got information about the presence of militants, following which they launched a search and cordon operation. The search operation turned into an encounter after militants opened fire on the forces, the official said.

Internet services have been suspended in Srinagar and other adjoining areas as a precautionary measure.

Ayodhya case: SC to revisit 1994 Verdict on ‘Whether Mosque Essential for Namaz’

The Supreme Court on September 27 will decide if a Constitution Bench should revisit the issue of whether namaz can be offered anywhere, or whether a mosque is an essential part of Islam and is needed for Namaz.

It will deliver a key verdict on the matter that could impact whether a temple will be built at Ayodhya or not.

A three-judge SC Bench of Chief Justice Dipak Misra and Justices Ashok Bhushan and S Abdul Nazeer, which is hearing appeals against the Allahabad High Court verdict of 2010, which had ordered a three-way partition of the disputed land between Muslims, Hindus and Nirmohi Akhara, will decide the matter.

The matter became critical during the hearing on Ayodhya case, which reached the apex court after the Allahabad High Court’s 2010 judgment was challenged.

Rajeev Dhavan, appearing for a Muslim petitioner, argued that the appeal from 2010 Allahabad High Court judgment dividing the disputed site into three parts could be heard only after the main issue is decided as a preliminary issue.

In 1994, the apex court said that namaz could be offered anywhere and that a mosque was not necessary for this.

Cabinet approves conversion of GSTN into government-owned entity

The Union Cabinet chaired by Prime Minister Narendra Modi on September 26 in New Delhi approved the proposal to convert GST Network (GSTN) into a government-owned company.

The GST Council chaired by Finance Minister Arun Jaitley and comprising of state finance ministers, had in May agreed to a proposal to make GSTN a government owned company, with Centre owning 50% stake and states together holding the remaining of 50%.

“Government has decided to convert GSTN, which was collectively owned by Centre, states and some private institutions will now become a wholly government-owned company. The in-principal decision was taken earlier and the Cabinet approved the proposal today,” Finance Minister Jaitley said.

Cabinet approves change in the existing structure with transitional plan as following:

Acquisition of entire 51% of equity held by the Non-Government Institutions in GSTN equally by the centre and the State Governments and allows GSTN Board to initiate the process for acquisition of equity held by the private companies.

The restructure GSTN with 100 percent government ownership shall have equity structure between the Centre (50 percent) and the States (50 %).
