Kathua rape case: Rahul Gandhi, party leaders hold midnight march

The people have shown outrage on April 12 reminiscent of the Nirbhaya rape protests that erupted on social media.

The Delhi High Court today has issued notices to several media houses who disclosed the identity of Kathua rape victim. The court took up the issue on its own after coming across print and electronic media reports revealing victim’s name.

Congress Chief Rahul Gandhi led a midnight march to India Gate on April 12 joined by his sister Priyanka and her husband Robert Vadra as also their children, in addition to scores of Congress leaders, party workers and others.  They shout slogans, carrying candles and some even placards against the BJP governments at the Centre and in Uttar Pradesh and Jammu & Kashmir.

Party demands urgent action against the perpetrators of two heinous gangrapes — one in Unnao (UP) and the other in Kathua (J&K).

Union Minister Maneka Gandhi in a video message has said, “I have been deeply, deeply disturbed by the rape case in Kathua and all the recent rape cases that have happened on children. I and the ministry intend to bring an amendment to the POCSO Act asking for the death penalty for rape on children below 12 years.”

A group of lawyers in the Apex Court have requested CJI Dipak Misra to take suo moto cognizance of the conduct of lawyers in Kathua and a PIL in this regard is likely to be filed on 13 April.

J&K DGP SP Vaid while condemning the politicization of the rape case has said, “It’s a very heinous crime. I wish the perpetrators get punished for brutally killing a small eight-year-old girl. We had constituted an SIT of crime branch, which had conducted a probe in a very professional manner. Let’s see what happens in court.”

He also wisely commented on PM Modi’s ‘Beti Bachao, Beti Padhao’ initiative, and said it was the right slogan and the Prime Minister must start work on ‘Beti Bachao’.

Even Congress leader Ghulam Nabi Azad said they were protesting to awaken the Modi government from its “slumber”.

The girl belonged to the nomadic Bakerwal Muslim community, had disappeared from a spot near her house on January 10.

Cauvery water row: Pro-Tamil outfits, other factions show black flags to PM Modi

PM Modi has arrived in the state to formally inaugurate India’s mega Defence Exhibition, Defexpo, at Thiruvidanthai.

Pro-Tamil outfits and another mixed group led by Pazha Nedumaran, president of Ulaga Thamizhar peramaippu, stage protest outside Chennai Airport by raising anti-Modi slogans and demanding the formation of the Cauvery Management Board.

Banners and hoardings carried by the protesters read ‘Go Back Modi, Down Down Modi’. These banners also made a mention of Tamil Nadu’s right over Cauvery.

In view of the protests, traffic was totally disturbed in many parts of the city and mostly the areas surrounding the airport. However, police dispersed some of the protesters and detained others; in Erode District alone 50 DMK workers were detained to control the situation.

After the protest, Vaiko, chief of MDMK (Marumalarchi Dravida Munnetra Kazhagam), has accused Indian chief justice of dancing to the tunes of Modi government.

“Modi is Coward. Only thieves will jump wall. Why didn’t he come by road like Nehru. He has broken a wall between IIT and Cancer institute only thieves jump walls (sic),” Vaiko added.

Kamal Haasan also recorded an open message for Modi, asking Modi to follow the apex court judgment on the Cauvery water dispute issue and deliver justice to Tamil Nadu.

12-feet minaret at Taj Mahal collapses due to heavy rainfall, thunderstorm

TajMahalDue to heavy rainfall and thunderstorm accompanied with high winds with velocity over 130 km per hour in Agra, reportedly a 12-feet minaret at the entry gate of Taj Mahal (an Iconic heritage site) has collapsed late on the evening of April 12. However, there were no casualties reported during the incident.

Sources have revealed that the main monument was also affected during that 40-minute heavy rainfall in the region.

The metal pillar which was referred to as Darwaza-e-Rauza was situated at the entry gate and it crashed during the thunderstorm and later the minaret fell off and the white dome broke into several pieces.

Meanwhile, 35 people have died and 24 others got injured due to extreme weather conditions in the state. This has even resulted in 80% crop damage. A pillar at a mosque in Jaunpur’s Shahganj also got crashed due to the same.

The state government has directed officials to provide compensation to the affected people.

While this was so, the Archeological Society of India had appealed in the Supreme Court to sort out the ownership of the Taj Mahal, against the Waqf board’s decision to declare Taj Mahal as its property. The Apex court has asked Sunni Waqf Board (Uttar Pradesh) to reveal the documents which were signed by Shah Jahan (Mughal emperor) to prove its ownership.

Unnao rape case: FIR registered against BJP MLA Kuldeep Singh Sengar

images (15) In the Unnao rape case incident, an FIR has been registered against BJP MLA Kuldeep Singh Sengar of Bangarmau district under Sections 363, 366, 376, 506 and POSCO Act, confirms Police SO Rajesh Singh.

 The Special Investigation Team (SIT), on April 11 midnight, headed by Lucknow Additional Director General of Police Rajeev Krishna submitted its report to the government. Earlier in the afternoon, the SIT team had visited the victim’s Makhi village and assured security for their protection. The content of the report is yet not known but reports say that the SIT has held Sengar guilty of conspiracy that led to the death of victim’s father.

 Victim’s uncle said,  “Yes, we are happy that finally an FIR has been registered against  Kuldeep Singh Sengar . Had this been done much earlier, my brother (victim’s father) would be alive today… still, let’s see if he will be arrested or not. I have been demanding CBI inquiry from the start. In case the SIT arrests the accused till evening, some faith in the administration will be restored. We will not go to Delhi until a decision is taken in this case. ”

In an interview to a news organisation, the rape survivor, who has accused BJP MLA Kuldeep Singh Sengar of sexually assaulting her, said the incident took place on June 4, 2017, when she was 16 years old. On that day, Sengar reportedly called her home, took her to his room and raped her, while accomplices sat outside the door.

“I screamed. I knew people were sitting outside in the corridor, but no one came to help me. After raping me, he asked me to leave and straightaway return home,” she told a news organisation, adding that Sengar wiped her tears and said he would get her a good job. He also allegedly threatened to kill her father and four-year-old brother if she filed a complaint.

BJP MLA from Bairia district Surendra Singh Singh, while defending his brother made a bizarre statement that no one can rape a mother of three children.

 “I am speaking from psychological point of view; no one can rape a mother of three children. It is not possible, this is a conspiracy against him (Kuldeep Singh Sengar),” said Surendra Singh.

The Allahabad High Court on April 11 taken a suo motu cognisance of the matter and decided to take up the matter for hearing on April 12. The court had also ordered not to cremate the victim’s father body.

Days before the death of the victim’s father, in a purported video that had gone viral, he was shown mercilessly beaten up by the MLA’s brother and others, including with rifle butts. It also showed the deceased person’s back with serious wounds, but its veracity could not be ascertained.

The video was reportedly shot on April 3 when he was taken to the hospital. He succumbed to his wounds on April 9.

In the video, the girl’s father is heard saying: “Vidhayak ke bhai ne maara hai. Police khadi rahi… maarte rahe. Police ne bachaya bhi nahi humko… bahut maara. Kuldeep ka bhai Atul Singh aur uske saath they chaar… Police khadi thi police bachayi nahi humko…. Maar ke jab adhmara kar diya tab humko yahan laaye (The MLA’s brother beat me up. The police were standing there while they kept beating me. Police did not rescue me… I was badly beaten. Kuldeep’s (Sengar) brother Atul and there were four others with him. The police did not help me. When I was half-dead, they brought me here),” according to media reports.

Meanwhile, reacting to the case, BJP leader Deepti Bhardwaj expressed, “No one is greater than Amit Shah in BJP and that’s why I thought I should inform him what has disgraced our party. This is a failure of UP govt because we fought for women’s respect but risked it just for saving image of an influential person. ”

Congress president Rahul Gandhi Gandhi tweeted, “The barbarism inflicted on a father seeking justice for his daughter in UP has shamed humanity. Hope the PM will soon observe a fast over atrocities against women, failed law and order and increasing anarchy under the BJP’s watch.”

Chief justice has ‘exclusive prerogative’ to allocate cases, rules SC

supreme court- 1The Supreme Court has ruled that the Chief Justice of India (CJI) is the “first among equals” and holds a unique position having the “exclusive prerogative” to allocate cases and set up benches to hear cases.

The verdict assumed significance as it came in the backdrop of the January 12 unprecedented press conference of senior-most judges including Justices J Chelameswar, Ranjan Gogoi, Madan B Lokur and Kurian Joseph raising the issue of improper allocation of cases, media reports said.

Senior advocate and former law minister Shanti Bhushan has also recently filed a PIL seeking clarification on the administrative authority of the CJI as the ‘master of roster’ and laying down of principles in preparing the roster for allocation of cases to different benches, reported PTI.

“In his capacity as a Judge, the CJI is primus inter pares: the first among equals. In the discharge of his other functions, the Chief Justice of India occupies a position which is sui generis (unique)…Article 146 reaffirms the position of the Chief Justice of India as the head of the institution.

“From an institutional perspective the Chief Justice is placed at the helm of the Supreme Court. In the allocation of cases and the constitution of benches, the Chief Justice has an exclusive prerogative,” a bench comprising Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud said.

Dismissing a PIL filed by Uttar Pradesh-based lawyer Ashok Pande seeking evolution of a “set procedure” to constitute benches and allot cases to different benches, the bench reportedly said that as a “repository of constitutional trust, the Chief Justice is an institution in himself”.

Justice Chandrachud, writing the judgement for the bench, referred to the Supreme Court Rules, 2013 and said they were notified with the approval of the President.

“Rule 1 indicates that it is the Chief Justice who is to nominate the Judges who would constitute a Bench to hear a cause, appeal or matter. Where a reference has been made to a larger Bench, the Bench making the reference is required to refer the matter to the Chief Justice who will constitute a Bench,” the judgement reportedly said.

Jammu lawyers call for complete shutdown, CBI probe in Kathua rape case

2018_4img10_Apr_2018_PTI4_10_2018_000129B-696x456The Jammu and Kashmir Police while investigating the alleged rape and murder of a minor Bakherwal community girl Asifa, who went missing on 10 January, filed a separate charge sheet on April 11 against another accused, who was earlier said to be a juvenile, at a court in Kathua District. On April 9 charge sheet was filed against seven out of eight accused in the case, the police official confirmed.

Mohd. Yousuf S/o Sahib Din (Victim’s father) has lodged a complaint in P/S Hiranagar on 12 January to the effect that his daughter is missing while she was grazing horses in the nearby forest. On 17 January Asifa’s corpse was recovered and was then taken for autopsy.

“We have filed a separate challan (charge sheet) against another accused in the court today,” a top police officer confirmed.

On April 9 Kathua bar association lawyers held protest demonstration over the presentation of the charge sheet by the crime branch in the rape case in the court of the Chief Judicial Magistrate. Kirty Bhushan Mahajan, Kathua Bar Association president, has said that the bar association is on strike protesting the crime branch probing the case and is in favour of a CBI inquiry.  In response to the same, the Jammu High Court Bar Association has called for a complete bandh in the Jammu region on 11 April.

J&K cops are accusing lawyers of shielding the rapists.

On 10 April an FIR was registered against the lawyers attempting to prevent the police from filing charge sheet in the Kathua rape and murder case.

The Congress Party and CPM have also condemned the lawyers’ protest, alleging that these protests were part of a well-thought-out conspiracy to polarise communities in the state.

Mark Zuckerberg Testifies to US Senate Members About Facebook Over Data Scandal

Facebook CEO Mark Zuckerberg has apologized several times on 10 April in front of the 42 members of the US Senate over failure to protect the personal information of millions of Americans from Russians intent on upsetting the US election.
Zuckenberg during some five hours of Senate questioning on Cambridge Analytica Data Scandal disclosed that his company was “working with” special counsel Robert Mueller in the federal probe of Russian election interference and said it was working hard to change its own operations.
He added that “Over the past few weeks, we’ve been working to understand exactly what happened with Cambridge Analytica and taking steps to make sure this doesn’t happen again.”
Even he said that Facebook took important actions to prevent this from happening again today four years ago, but we also made mistakes, there’s more to do, and we need to step up and do it.
When grilled over Cambridge Analytica Row he further added that previous month, we learned from The Guardian, The New York Times and Channel 4 that Cambridge Analytica may not have deleted the data as they had certified. We immediately banned them from using any of our services.
But on other hand the Cambridge Analytica has claimed that they have already deleted the data and has agreed to a forensic audit by a firm we hired to investigate this.
When responding to Russian interference Zuckenberg said “We will continue working with the Russian Government to understand the full extent of Russian interference, and we will do our part.” Claiming that they are too slow to spot and respond to Russian interference, but they are working hard to get better.
Facebook is working on building new technologies, building better controls, investigating other apps having an access to large amount of information; we are in process of restricting more APIs like groups and events. We are trying our best to safeguard our platform in order not to repeat this kind of mistakes ever.

BJP’s income doubles to Rs 1,034 crore, making it richest party

The income of the ruling BJP soared 81% to more than Rs 1,034 crore in 2016-17 from Rs 570 crore in 2015-16, the latest annual audit reports filed with the Election Commission suggested, adding that seven national parties declared a total income of ₹1,559.17 crore in 2016-17.

“This forms 66.34% of the total income of national parties added together during 2016-17,” a report by Delhi-based think-tank Association for Democratic Reforms (ADR) has pointed out.

The Indian National Congress followed with ₹225.36 crore — 14.45% of the total income, it said, adding that the CPI has declared the lowest income of ₹2.08 crore which forms a mere 0.13%, PTI quoted the report as saying.

The data has been compiled from Income Tax returns filed by the parties across the country. The seven national parties declared a total expenditure of ₹1,228.26 crore, the report added.

The BJP declared the maximum expenditure of ₹710.05 crore in 2016-17, while the Congress incurred a total expense of ₹321.66 crore (₹96.30 crore more than its total income), media reports said.

The report further said that 70% of the total income of the BSP, 31% of the total income of the BJP and the CPI and 6% of the total income of the CPI(M) was declared unspent during 2016-17.

The BSP’s total income was ₹173.58 crore during 2016-17, while its total expenditure was ₹51.83 crore. Between 2015-16 and 2016-17, the income of the BJP increased by 81.18% from ₹570.86 crore to ₹1,034.27 crore, while that of the Congress decreased by 14% from ₹261.56 crore to ₹225.36 crore.

Income of the BSP increased by 266.32% from ₹47.38 crore during 2015-16 to ₹173.58 crore in 2016-17, while that of the NCP increased by 88.63% from ₹9.137 crore during 2015-16 to ₹17.235 crore in 2016-17, it was pointed out.

The report noted that between 2015-16 and 2016-17, the income of the All India Trinamool Congress decreased by 81.52% and that of the CPI(M) fell by 6.72%.

The BJP and the Congress have declared donations/contributions as one of their three main sources of income. “Grants/donations/contributions of ₹997.12 crore declared by BJP formed 96.41% of the total income of the party during 2016-17. Declaration of ₹115.64 crore under revenue from the issuance of coupons by INC forms the topmost income of the party, contributing 51.32% of the total income of the party during 2016-17,” ADR reportedly said.

The maximum expenditure for the BJP during 2016-17 was towards election/general propaganda, which amounted to ₹606.64 crore followed by expenses towards administrative cost at ₹69.78 crore. The Congress spent the maximum ₹149.65 crore on election expenditure followed by the expenditure of ₹115.65 crore on administrative and general expenses, the report said.

Seven national parties have collected maximum 74.98% (₹1,169.07 crore) income from voluntary contributions for 2016-17. During 2016-17, national parties received ₹128.60 crore income from interest from banks and FD. The report added that 7.98% or ₹124.46 crore was the income generated through revenue from the issuance of coupons by national parties during 2016-17, the report highlighted.

30 killed including 27 children as school bus falls into gorge in Himachal Pradesh

himachal bus accidentAround 30 people, including 27 school children, two teachers, and a driver were killed on April 9 after a private school bus skidded off the road and fell down into a gorge in Nurpur area of Kangra district in Himachal Pradesh

Twelve injured passengers, who were rushed to the hospital are reported to be in critical condition.

According to a senior police officer the bus rolled into a 20ft-deep gorge.

“The bus rolled into a 200ft-deep gorge, killing 27 schoolchildren, two teachers and the driver,” said Santosh Patyal, a senior local police official.

“My first priority was to save lives. We will now investigate the reasons for the accident,” he said.

Most of the students were said to be at the age of 10 to 12 years.

The incident happened when around 45 students of Wazir Ram Singh Pathania Memorial Public School were returning home.

Local administration teams and the National Disaster Response Force were involved in the rescue operations.

A magisterial inquiry has been ordered.

Many political leaders including Prime Minister Narendra Modi, Congress President Rahul Gandhi, Chief Minister Jai Ram Thakur, Governor Acharya Devvrat and Union Health Minister J.P. Nadda have condoled the deaths.

“I am deeply anguished by the loss of lives due to a bus accident in Kangra, Himachal Pradesh. My prayers and solidarity with those who lost their near and dear ones in the accident,” tweeted PMO India.

 “I am deeply disturbed and saddened by the bus accident in Himachal, that has claimed many lives, including those of 26 children,” Gandhi tweeted. “I urge our Congress party workers in Himachal to provide all the assistance they can, to the families of the victims and to those who are injured,” he added.
