{"id":327356,"date":"2020-10-08T11:37:28","date_gmt":"2020-10-08T11:37:28","guid":{"rendered":"http:\/\/tehelka.com\/?p=327356"},"modified":"2020-10-08T11:37:28","modified_gmt":"2020-10-08T11:37:28","slug":"freedom-of-speech-most-abused-sc-while-hearing-tablighi-jamaat-pleas","status":"publish","type":"post","link":"https:\/\/tehelka.com\/freedom-of-speech-most-abused-sc-while-hearing-tablighi-jamaat-pleas\/","title":{"rendered":"Freedom of speech most abused: SC while hearing Tablighi Jamaat pleas"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><img decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-305446 aligncenter\" src=\"http:\/\/tehelka.com\/wp-content\/uploads\/2018\/11\/Supreme-Court.jpg\" alt=\"\" width=\"660\" height=\"438\" srcset=\"https:\/\/tehelka.com\/media\/2018\/11\/Supreme-Court.jpg 660w, https:\/\/tehelka.com\/media\/2018\/11\/Supreme-Court-300x199.jpg 300w, https:\/\/tehelka.com\/media\/2018\/11\/Supreme-Court-633x420.jpg 633w\" sizes=\"(max-width: 660px) 100vw, 660px\" \/>Freedom of speech and expression\u00a0is the most abused right during recent times, the Supreme Court said on Thursday while hearing a case related to media reporting on the Tablighi Jamaat incident.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A bench headed by Chief Justice S A Bobde was hearing pleas filed by Jamiat Ulama-i-Hind and others seeking action against the media, allegedly giving communal hatred over Tablighi Jamaat congregation in Delhi\u2019s Nizamuddin during the onset of COVID-19 pandemic.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Senior Advocate Dushyant Dave, appearing for the petitioners said that the Centre, in its affidavit has stated that the Jamaat is &#8216;trying to muzzle&#8217; freedom of speech by targeting the media.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Responding, the court said, \u201cThey are free to make any averment in their affidavit, like you are free to make any argument you want.\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The bench raised question over the fact that instead of secretary of the Information and Broadcasting Ministry, a junior official filed the affidavit which contained \u201cunnecessary\u201d and \u201cnon-sensical\u201d averments with regard to media reporting on the case.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">&#8220;You cannot treat this court the way you are doing in this case,&#8221; the bench said.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The court has posted the matter for hearing after two weeks.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The Tablighi Jamaat congregation at Markaz in Delhi&#8217;s Nizamuddin had become the epicentre of COVID-19 in March.
