{"id":324903,"date":"2020-07-23T11:37:42","date_gmt":"2020-07-23T11:37:42","guid":{"rendered":"http:\/\/tehelka.com\/?p=324903"},"modified":"2020-07-23T11:45:56","modified_gmt":"2020-07-23T11:45:56","slug":"sc-refuses-to-restrain-rajasthan-hc-proceedings-on-rebel-congress-mlas-petition","status":"publish","type":"post","link":"https:\/\/tehelka.com\/sc-refuses-to-restrain-rajasthan-hc-proceedings-on-rebel-congress-mlas-petition\/","title":{"rendered":"SC refuses to restrain Rajasthan HC proceedings on rebel Congress MLAs\u2019 petition"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><img decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-299685 aligncenter\" src=\"http:\/\/tehelka.com\/wp-content\/uploads\/2018\/06\/Supreme-Court-2.jpg\" alt=\"\" width=\"636\" height=\"371\" srcset=\"https:\/\/tehelka.com\/media\/2018\/06\/Supreme-Court-2.jpg 636w, https:\/\/tehelka.com\/media\/2018\/06\/Supreme-Court-2-300x175.jpg 300w\" sizes=\"(max-width: 636px) 100vw, 636px\" \/>The Supreme Court on Thursday refused to restrain the Rajasthan High Court from passing an order on rebel Congress MLAs\u2019 petition over the disqualification notices issued to them by state Assembly Speaker CP Joshi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The apex court allowed the Rajasthan high court to go ahead and deliver its judgement on the plea by the dissident MLAs against the disqualification notices.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">However, the top court said that the high court\u2019s judgment will be subject to the proceedings before the apex court.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cLet the high court deliver the judgement tomorrow,\u201d the Top Court said.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The Bench said it will further hear the matter on July 27.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Former Deputy CM Sachin Pilot and rebel Congress MLAs have challenged the Speaker\u2019s notices in court saying the notices under anti-defection law were not maintainable as voicing dissent does not amount to defection.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">On Tuesday, the Rajasthan High Court said it will pronounce its decision on July 24 on a petition filed by Sachin Pilot and his team of rebels and requested the speaker not to take any action against the MLAs till then.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Amid the tussle between Sachin Pilot and Chief Minister\u00a0Ashok Gehlot, the Congress had sacked Pilot as the Rajasthan deputy chief minister and the president of the state Congress unit.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The decision was taken after Pilot along with his MLAs skipped the Congress Legislature Party meetings.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court on Thursday refused to restrain the Rajasthan High Court from passing an order on rebel Congress MLAs\u2019 petition over the disqualification notices issued to them by state Assembly Speaker CP Joshi.
