{"id":312084,"date":"2019-05-09T07:05:16","date_gmt":"2019-05-09T07:05:16","guid":{"rendered":"http:\/\/tehelka.com\/?p=312084"},"modified":"2019-05-09T07:05:16","modified_gmt":"2019-05-09T07:05:16","slug":"sc-collegium-recommends-justice-br-gavai-justice-surya-kant-for-elevation-to-apex-court","status":"publish","type":"post","link":"https:\/\/tehelka.com\/sc-collegium-recommends-justice-br-gavai-justice-surya-kant-for-elevation-to-apex-court\/","title":{"rendered":"SC collegium recommends Justice BR Gavai, Justice Surya Kant for elevation to Apex Court"},"content":{"rendered":"<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><img decoding=\"async\" loading=\"lazy\" class=\" wp-image-305446 aligncenter\" src=\"http:\/\/tehelka.com\/wp-content\/uploads\/2018\/11\/Supreme-Court-300x199.jpg\" alt=\"\" width=\"439\" height=\"291\" srcset=\"https:\/\/tehelka.com\/media\/2018\/11\/Supreme-Court-300x199.jpg 300w, https:\/\/tehelka.com\/media\/2018\/11\/Supreme-Court-633x420.jpg 633w, https:\/\/tehelka.com\/media\/2018\/11\/Supreme-Court.jpg 660w\" sizes=\"(max-width: 439px) 100vw, 439px\" \/><\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The Supreme Court Collegium has recommended the names of two justices to the government for elevation to the Supreme Court- Justice B R Gavai and Justice Surya Kant.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Justice Gavai is currently a judge of the Bombay High Court and Justice Kant is the Chief Justice of the Himachal Pradesh High Court.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The collegium includes Chief Justice of India Ranjan Gogoi, Justice SA Bobde, Justice NV Ramana, Justice Arun Mishra and Justice RF Nariman.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The five-member Collegium on Wednesday recommended these two names for their elevation as Supreme Court judges.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The Centre had sent back the Supreme Court collegium\u2019s recommendation to elevate Justices Aniruddha Bose and AS Bopanna, asking the body to reconsider its decision.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Aniruddha Bose is the Chief Justice of the Jharkhand High Court and AS Bopanna is Chief Justice of Gauhati High Court.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cBoth the judges have been recommended after taking into consideration the seniority criterion as well as\u00a0their competence, conduct and integrity,\u201d the Collegium said.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cJustice Gavai\u2019s elevation has been recommended also keeping in view SC\/ST representation at the Supreme Court,\u201d the collegium added, \u201cOn his appointment, the Supreme Court Bench will have a Judge belonging to Scheduled Caste category after about a decade.\u201d<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court Collegium has recommended the names of two justices to the government for elevation to the Supreme Court- Justice B R Gavai and Justice Surya Kant.
