{"id":311174,"date":"2019-04-10T08:19:52","date_gmt":"2019-04-10T08:19:52","guid":{"rendered":"http:\/\/tehelka.com\/?p=311174"},"modified":"2019-04-10T08:38:46","modified_gmt":"2019-04-10T08:38:46","slug":"sc-dismisses-govts-objections-allows-use-of-leaked-documents-in-review-petitions","status":"publish","type":"post","link":"https:\/\/tehelka.com\/sc-dismisses-govts-objections-allows-use-of-leaked-documents-in-review-petitions\/","title":{"rendered":"SC dismisses govt\u2019s objections, allows use of leaked documents in review petitions"},"content":{"rendered":"<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><img decoding=\"async\" loading=\"lazy\" class=\" wp-image-305446 aligncenter\" src=\"http:\/\/tehelka.com\/wp-content\/uploads\/2018\/11\/Supreme-Court-300x199.jpg\" alt=\"\" width=\"522\" height=\"346\" srcset=\"https:\/\/tehelka.com\/media\/2018\/11\/Supreme-Court-300x199.jpg 300w, https:\/\/tehelka.com\/media\/2018\/11\/Supreme-Court-633x420.jpg 633w, https:\/\/tehelka.com\/media\/2018\/11\/Supreme-Court.jpg 660w\" sizes=\"(max-width: 522px) 100vw, 522px\" \/><\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The Supreme Court on Wednesday dismissed the government\u2019s preliminary objections against using privileged documents for considering the review petitions in the Rafale case.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The top Court said that the review petitions will be heard on merits and a date will be fixed for that.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A bench of Chief Justice of India\u00a0Ranjan Gogoi\u00a0and Justice S K Kaul and Justice K M Joseph in a unanimous decision has held that it would consider the papers while examining the review petition.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">CJI Gogoi said the review petition would be considered on the basis of the three documents whose admissibility was questioned.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The petitioners have sought for review of the December 14 judgment dismissing the plea for probe into the corruption allegations in the Rafale deal by relying on reports published by &#8216;The Hindu&#8217;,<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Justice KM Joseph also concurred with the conclusion but wrote a separate judgment.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">On March 14 the court had reserved its decision after hearing the Centre and the petitioners.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; font-family: 'times new roman', times, serif; font-size: 14pt;\">The Court was hearing the review petitions filed by Prashant Bhushan, Yashwant Sinha and Arun Shourie against the December 14 judgment when the top court had dismissed the petitions and said that there was no reason to \u2018doubt the decision-making process\u2019.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court on Wednesday dismissed the government\u2019s preliminary objections against using privileged documents for considering the review petitions in the Rafale case.
