{"id":308432,"date":"2019-01-23T05:50:41","date_gmt":"2019-01-23T05:50:41","guid":{"rendered":"http:\/\/tehelka.com\/?p=308432"},"modified":"2019-01-23T05:50:41","modified_gmt":"2019-01-23T05:50:41","slug":"child-from-marriage-of-muslim-man-hindu-woman-entitled-to-fathers-property-sc","status":"publish","type":"post","link":"https:\/\/tehelka.com\/child-from-marriage-of-muslim-man-hindu-woman-entitled-to-fathers-property-sc\/","title":{"rendered":"Child from marriage of Muslim man, Hindu woman, entitled to father&#8217;s property: SC"},"content":{"rendered":"<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><img decoding=\"async\" loading=\"lazy\" class=\" wp-image-305446 aligncenter\" src=\"http:\/\/tehelka.com\/wp-content\/uploads\/2018\/11\/Supreme-Court-300x199.jpg\" alt=\"\" width=\"565\" height=\"375\" srcset=\"https:\/\/tehelka.com\/media\/2018\/11\/Supreme-Court-300x199.jpg 300w, https:\/\/tehelka.com\/media\/2018\/11\/Supreme-Court-633x420.jpg 633w, https:\/\/tehelka.com\/media\/2018\/11\/Supreme-Court.jpg 660w\" sizes=\"(max-width: 565px) 100vw, 565px\" \/><\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The\u00a0Supreme Court\u00a0on Tuesday said that although the\u00a0marriage\u00a0between a Muslim man and Hindu woman is an irregular marriage, described as &#8220;fasid&#8221; in Mohamadan law, the children born out of this wedlock are legitimate and have claim over the property of the father.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A bench of Justices N V Ramana and Mohan M Shantanagoudar\u00a0in their judgement said,\u201d The\u00a0marriage\u00a0of a Muslim man with an idolater or fire\u00adworshipper is neither a valid nor a void marriage but is merely an irregular marriage.\u00a0Any child born out of such wedlock is entitled to claim a share in his father&#8217;s property.\u201d<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Upholding an order of the Kerala High Court, the bench said: &#8220;It would not be out of place to emphasise at this juncture that since Hindus are idol worshippers, which includes worship of physical images, it is clear that the marriage of a Hindu female with a Muslim male is not a regular or valid marriage, but merely an irregular marriage.&#8221;<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The ruling came on a petition in a property dispute between one Shamsudeen, the son of a couple &#8211; Mohammed Ilias, a muslim man and, Valliamma, a Hindu woman and his cousins.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The Kerala High Court held Shamsudeen &#8211; the legitimate son of Ilias and Valliamma and is entitled to his share in the property.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">However, the cousins contended that Shamsudeen\u2019s mother was not legally wedded to Ilias and that she was a Hindu by religion at the time of marriage.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">They claimed that Valliamma did not convert to islam at the time of her marriage.
