{"id":306981,"date":"2018-12-14T05:55:20","date_gmt":"2018-12-14T05:55:20","guid":{"rendered":"http:\/\/tehelka.com\/?p=306981"},"modified":"2018-12-14T05:55:20","modified_gmt":"2018-12-14T05:55:20","slug":"supreme-court-dismisses-petitions-seeking-probe-into-rafale-deal","status":"publish","type":"post","link":"https:\/\/tehelka.com\/supreme-court-dismisses-petitions-seeking-probe-into-rafale-deal\/","title":{"rendered":"Supreme Court dismisses petitions seeking probe into Rafale deal"},"content":{"rendered":"<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><img decoding=\"async\" loading=\"lazy\" class=\" wp-image-305446 aligncenter\" src=\"http:\/\/tehelka.com\/wp-content\/uploads\/2018\/11\/Supreme-Court-300x199.jpg\" alt=\"\" width=\"556\" height=\"369\" srcset=\"https:\/\/tehelka.com\/media\/2018\/11\/Supreme-Court-300x199.jpg 300w, https:\/\/tehelka.com\/media\/2018\/11\/Supreme-Court-633x420.jpg 633w, https:\/\/tehelka.com\/media\/2018\/11\/Supreme-Court.jpg 660w\" sizes=\"(max-width: 556px) 100vw, 556px\" \/><\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The Supreme Court on Friday dismissed a group of petitions seeking an inquiry into the controversial Rafale fighter jet deal from French company Dassault Aviation.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The judgement was delivered by a three-judge bench comprising Chief Justice Ranjan Gogoi, Justice KM Joseph and Justice Sanjay Kishan Kaul.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Chief Justice Ranjan Gogoi said, \u201cthe court was satisfied that the process for procurement had been complied with in the case of Rafale.\u201d<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cThe apex court cannot sit in judgment over the decision to buy 36 aircraft instead of 126, neither can it go into the details of pricing,\u201d the bench said.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">On pricing, Gogoi said that it wasn\u2019t its job of court to examine specific financial details such as the cost of an individual aircraft.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Gogoi further said it is not for the Centre but for the vendor to decide on offset partner in the deal. It is not the court\u2019s job to go into this either.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The judges were ruling on a batch of petitions filed against the Narendra Modi government\u2019s purchase of 36 Rafale, the petitions were filed by lawyer Manohar Lal Sharma, AAP legislator Sanjay Singh, former BJP leaders Yashwant Sinha, Arun Shourie and lawyer Prashant Bhushan.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The Supreme Court on November 14 had\u00a0reserved\u00a0its verdict on the petitions, saying the pricing details of the deal need not be discussed at the time.\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court on Friday dismissed a group of petitions seeking an inquiry into the controversial Rafale fighter jet deal from French company Dassault Aviation.
