{"id":305452,"date":"2018-11-12T09:09:39","date_gmt":"2018-11-12T09:09:39","guid":{"rendered":"http:\/\/tehelka.com\/?p=305452"},"modified":"2018-11-12T09:09:39","modified_gmt":"2018-11-12T09:09:39","slug":"parliament-has-to-take-a-call-in-the-issue-says-sc-on-gender-neutral-rape-laws","status":"publish","type":"post","link":"https:\/\/tehelka.com\/parliament-has-to-take-a-call-in-the-issue-says-sc-on-gender-neutral-rape-laws\/","title":{"rendered":"Parliament has to take a call in the issue, says SC on gender neutral rape laws"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><img decoding=\"async\" loading=\"lazy\" class=\" wp-image-299685 aligncenter\" src=\"http:\/\/tehelka.com\/wp-content\/uploads\/2018\/06\/Supreme-Court-2-300x175.jpg\" alt=\"\" width=\"429\" height=\"250\" srcset=\"https:\/\/tehelka.com\/media\/2018\/06\/Supreme-Court-2-300x175.jpg 300w, https:\/\/tehelka.com\/media\/2018\/06\/Supreme-Court-2.jpg 636w\" sizes=\"(max-width: 429px) 100vw, 429px\" \/><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The Supreme Court on November 12\u00a0has\u00a0refused to hear a petition which sought to strike down the rape law under section 375 of the Indian Penal Code (IPC) on the ground that it is not gender neutral.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The top court states that it is not the appropriate forum to deal with the case and suggested that the Parliament can amend the law if required.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The Section 375 of the IPC only covers instances of rape of a woman by a man.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The petition is filed by the Criminal Justice Society of India.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">While dismissing the petition,\u00a0Chief Justice of India Ranjan Gogoi said, \u201cWe are not inclined to interfere at this stage.\u00a0Parliament has to take a call in the issue.\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">CJI Ranjan Gogoi and Justice S K Kaul also asked, \u201cWhy should women also be not made liable for raping man, or a man for raping another man?\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The sexual assault law, which was amended in 2013, widened the definition of rape but did not make any single change that includes men or transgenders as victims under the law.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court on November 12\u00a0has\u00a0refused to hear a petition which sought to strike down the rape law under section 375 of the Indian Penal Code (IPC) on the ground that it is not gender neutral.
