Any provision treating a woman with inequality is not constitutional.\u201d<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The SC added that \u201cwithout a shadow of doubt\u201d, it can still be grounds for divorce.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The apex court bench added, \u201cAdultery might not be the cause of an unhappy marriage, it could be the result of an unhappy marriage. Mere adultery can\u2019t be a crime unless it attracts the scope of Section 306 (abetment to suicide) of the IPC. Thinking of adultery as a criminal offence is a retrograde step.\u201d<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">CJI Misra added, &#8220;there can&#8217;t be any social licence which destroys a home.&#8221;<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">SC judges felt, &#8220;In case of adultery, criminal law expects people to be loyal which is a command which gets into the realm of privacy.&#8221;\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>While scrapping a 158-year law that punished a man for adultery but not the woman, treating her as her husband&#8217;s property, the Supreme Court says Adultery is no longer a crime in India but could be a ground for divorce.
