{"id":302241,"date":"2018-09-04T15:37:53","date_gmt":"2018-09-04T15:37:53","guid":{"rendered":"http:\/\/tehelka.com\/?p=302241"},"modified":"2018-09-04T15:37:53","modified_gmt":"2018-09-04T15:37:53","slug":"sc-refuses-purohits-plea-seeking-sit-into-his-illegal-detention-in-malegaon-blasts-case","status":"publish","type":"post","link":"https:\/\/tehelka.com\/sc-refuses-purohits-plea-seeking-sit-into-his-illegal-detention-in-malegaon-blasts-case\/","title":{"rendered":"SC refuses Purohit&#8217;s plea seeking SIT into his illegal detention in Malegaon blasts case"},"content":{"rendered":"<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><img decoding=\"async\" loading=\"lazy\" class=\" wp-image-299685 aligncenter\" src=\"http:\/\/tehelka.com\/wp-content\/uploads\/2018\/06\/Supreme-Court-2-300x175.jpg\" alt=\"\" width=\"634\" height=\"370\" srcset=\"https:\/\/tehelka.com\/media\/2018\/06\/Supreme-Court-2-300x175.jpg 300w, https:\/\/tehelka.com\/media\/2018\/06\/Supreme-Court-2.jpg 636w\" sizes=\"(max-width: 634px) 100vw, 634px\" \/>The Supreme Court on September 4 refused to entertain a plea by Lieutenant Colonel Srikant Prasad Purohit&#8217;s seeking a Special Investigation Team (SIT) probe into his alleged abduction and torture by the Anti-Terrorism Squad in connection with 2008 Malegaon blasts case.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The SC bench, comprising Justices Ranjan Gogoi, Naveen Sinha and K M Joseph, said that admission of the plea may interfere with the ongoing trial in the case.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A bench decided it was &#8220;not appropriate&#8221; for the Supreme Court to consider this petition and asked Purohit to approach the trial court.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The court said that the matter pertaining to the validity of sanction for prosecution against Purohit under the Unlawful Activities (Prevention) Act need to be decided by the trial court.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The direction allowing Purohit to raise his contentions in the trial court came after the SC agreed with senior advocate Harish Salve, appearing for Purohit, that \u201csome forum had to look into it\u201d.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">&#8220;It is good that it has been decided who is going to take up the matter. He will definitely get relief. The High Court has told that the trial court should decide the matter.
