{"id":301307,"date":"2018-08-09T15:58:00","date_gmt":"2018-08-09T15:58:00","guid":{"rendered":"http:\/\/tehelka.com\/?p=301307"},"modified":"2018-08-09T15:58:00","modified_gmt":"2018-08-09T15:58:00","slug":"triple-talaq-bill-amendments-cabinet-approves-provision-of-granting-bail-by-magistrate","status":"publish","type":"post","link":"https:\/\/tehelka.com\/triple-talaq-bill-amendments-cabinet-approves-provision-of-granting-bail-by-magistrate\/","title":{"rendered":"Triple Talaq Bill Amendments: Cabinet approves provision of granting bail by magistrate"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><img decoding=\"async\" loading=\"lazy\" class=\" wp-image-301308 aligncenter\" src=\"http:\/\/tehelka.com\/wp-content\/uploads\/2018\/08\/triple-talaq-300x168.jpg\" alt=\"\" width=\"598\" height=\"335\" srcset=\"https:\/\/tehelka.com\/media\/2018\/08\/triple-talaq-300x168.jpg 300w, https:\/\/tehelka.com\/media\/2018\/08\/triple-talaq.jpg 682w\" sizes=\"(max-width: 598px) 100vw, 598px\" \/>The Union Cabinet on August 9 approved inclusion of a provision of granting bail to men accused of giving instant triple talaq to their wives in the Muslim Women Protection of Rights on Marriage Bill, government sources said.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The opposition demanded provision of bail and under the amendments cleared on August 9, the magistrate would have powers to grant bail to the accused, the sources said.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The proposed amended law would only be applicable to instant triple talaq or \u2018talaq-e-biddat\u2019 and it would give power to the victim to approach a magistrate seeking \u201csubsistence allowance\u201d for her and minor children.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Giving away instant triple talaq will continue to be illegal and will attract a jail term of three years for the husband.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><b>Cabinet proposed three amendments:<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">First, if the husband gives triple talaq instantaneously and breaks marriage then FIR shall only become cognizable when it is filed by the victim or blood relation or relation by marriage.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Second, it has been made compoundable &#8211; if the wife and the husband desire to settle their differences then the magistrate can compound the offense on appropriate terms and conditions.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Third and finally, magistrate can grant bail after hearing the wife.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Union Cabinet on August 9 approved inclusion of a provision of granting bail to men accused of giving instant triple talaq to their wives in the Muslim Women Protection of Rights on Marriage Bill, government sources said.
