{"id":300322,"date":"2018-07-13T05:11:10","date_gmt":"2018-07-13T05:11:10","guid":{"rendered":"http:\/\/tehelka.com\/?p=300322"},"modified":"2018-07-13T05:11:10","modified_gmt":"2018-07-13T05:11:10","slug":"pakistan-to-file-counter-memorial-in-kulbhushan-jadhav-case-in-icj","status":"publish","type":"post","link":"https:\/\/tehelka.com\/pakistan-to-file-counter-memorial-in-kulbhushan-jadhav-case-in-icj\/","title":{"rendered":"Pakistan to file counter-memorial\u00a0in Kulbhushan Jadhav case in ICJ"},"content":{"rendered":"<div>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><img decoding=\"async\" loading=\"lazy\" class=\" wp-image-300323 alignleft\" src=\"http:\/\/tehelka.com\/wp-content\/uploads\/2018\/07\/yadav-300x285.jpg\" alt=\"\" width=\"275\" height=\"261\" srcset=\"https:\/\/tehelka.com\/media\/2018\/07\/yadav-300x285.jpg 300w, https:\/\/tehelka.com\/media\/2018\/07\/yadav.jpg 614w, https:\/\/tehelka.com\/media\/2018\/07\/yadav-442x420.jpg 442w\" sizes=\"(max-width: 275px) 100vw, 275px\" \/>Pakistan will reportedly file its second counter-memorial on\u00a0<span class=\"aBn\" tabindex=\"0\" data-term=\"goog_1867290221\"><span class=\"aQJ\">July 17<\/span><\/span>\u00a0in the International Court of Justice (ICJ) on the conviction of former Indian Naval officer Kulbhushan Jadhav who was arrested from Balochistan Province, and was awarded death penalty by Pakistani military court in April 2017 on charges of espionage and terrorism.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The ICJ on\u00a0<span class=\"aBn\" tabindex=\"0\" data-term=\"goog_1867290222\"><span class=\"aQJ\">January 23<\/span><\/span>\u00a0gave a timeline to both Pakistan and India for filing another round of memorials in the case.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Pakistan&#8217;s counter-petition will be in response to set of pleadings filed by India in the Hague-based ICJ on\u00a0<span class=\"aBn\" tabindex=\"0\" data-term=\"goog_1867290223\"><span class=\"aQJ\">April 17<\/span><\/span>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Pakistan&#8217;s top attorney Khawar Qureshi, who pleaded the case at the initial stage, reportedly briefed interim Prime Minister Nasirul Mulk regarding the case last week. The meeting was also attended by Khalid Javed Khan, attorney general for Pakistan, and other senior officials.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The counter-memorial has been drafted by Qureshi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Following the submission of the second counter-petition, the ICJ will fix the matter for hearing, which is likely to take place next year.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">&#8220;Giving false identity to Kulbhushan, sending him for espionage and funding of terrorists activities are all some of the reasons which disentitle India from invoking the jurisdiction of the ICJ,&#8221; Pakistan had said.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">However, India has been maintaining that the trial of Jadhav by a military court in Pakistan was &#8216;farcical&#8217;.\u00a0<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">India maintained that Jadhav was a former naval officer and was kidnapped from Iran, where he had business interests after retiring from the Indian Navy.<\/span><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Pakistan will reportedly file its second counter-memorial on\u00a0July 17\u00a0in the International Court of Justice (ICJ) on the conviction of former Indian Naval officer Kulbhushan Jadhav who was arrested from Balochistan Province, and was awarded death penalty by Pakistani military court in April 2017 on charges of espionage and terrorism.
