The Rajasthan High court on Friday ordered status quo to be maintained in the disqualification case against Sachin Pilot and rebel Congress MLAs.
With this order, the speaker cannot act on disqualification notices against dissident MLAs.
The order came after the Rajasthan high court agreed to Sachin Pilot’s request to make Centre a party to the case.
The state Assembly Speaker CP Joshi had approached the Supreme Court urging it to stay the High Court proceedings on rebel MLAs plea. However, the top court yesterday refused to restrain the HC from passing its order.
Former Deputy CM Sachin Pilot and rebel Congress MLAs have challenged the Speaker’s notices in court saying the notices under anti-defection law were not maintainable as voicing dissent does not amount to defection.
Amid the tussle between Sachin Pilot and Chief Minister Ashok Gehlot, the Congress had sacked Pilot as the Rajasthan deputy chief minister and the president of the state Congress unit.
The decision was taken after Pilot along with his MLAs skipped the Congress Legislature Party meetings.
